Council Meeting Minutes – May 4, 2009

May 4, 2009

The regular meeting of the Belle Plaine City Council met on May 4, 2009 at 6:00 p.m. in the city council chambers with Mayor Jim Daily presiding. Present:  James Kurovski, Marv DeRycke, Harold Ealy and Steve Beck.  Also present: City Attorney Larry Schlue and City Administrator Bill Daily.  Absent:  CraigVan Scoyoc.

Motion by DeRycke to approve the consent agenda consisting of the April 20th council minutes, bills @ $290,245.29 and the receiving/filing of minutes from the Committee of the Whole – April 20th; Planning & Zoning Committee-March 9th and Library Board – March 24th, second by Ealy. On roll call all voted aye. Motion carried.

Public Hearing – 6:00 p.m. Delinquent Dog & Cat Licensing.  Mayor Daily opened the Public Hearing. A list of 8 delinquent dog/cats licenses were handed out.  City Administrator Bill Daily stated  that residents had been notified several times concerning the delinquent licensing.  A final certified letter was sent to the owners with no response.  Motion by Ealy to direct city employees to follow the Belle Plaine Code and issue citations to the owners, second by DeRycke. On roll call all voted aye. Motion carried.

Nuisance Hearing – Vicky Nickel 615 7th Avenue:  Nickel was present to ask the Council for a 90 day extension to abate the metal building that had collapsed for a second time.  Nickel explained that it is her wish to build a sturdy building and eventually tear this building down but she would need more time to do this.  Motion by Beck to grant a 90 day extension (August 4th – 6:00 p.m.) to Vicky Nickel 615 7th Avenue to abate the citied nuisance, second by Kurovski. On roll call all voted aye. Motion carried.

Motion by DeRycke to table the 2nd reading of Ordinance #09-2 until a full council is present, second by Beck. On roll call all voted aye. Motion carried.

Motion by Beck to approve Resolution #09-5-1 of Necessity for unpaid mowing, utility, and miscellaneous bills, second by Ealy. On roll call all voted aye. Motion carried.

Mayor Daily read the Proclamation for Iowa School Board Recognition Week – May 10-16, 2009.

Ed Landuyt  1005 13th Avenue  asked  the Council when the he would be getting sewer service.  Landuyt stated that past city councils have promised sewer service to his area when the Benco building was sold.  Mayor Daily told Landuyt this request would be put on the May Committee of the Whole meeting agenda.

City Administrator Report:

  • City Administrator Bill Daily stated the CAT Grant Presentation will be held on Wednesday, May 13th at 10:00 a.m. in Des Moines. Bill encouraged the Council to attend if possible.
  • Belle Plaine has been informed that the Benton County Foundation Board granted $6000 for Belle Plaine’s Streetscape Project and $8000 for the Aquatic Center.
  • The Downtown Fascade Project is presently on hold.
  • City plans are to take bids for the future Aquatic Facility in July and demolition of the pool would start in August. Hopefully, the new facility would be ready in spring of 2010. Plans are now being drawn up.

Residents Comments:  Jon Papesh was present to state that he is not financially able to license his dog.  Bill explained there would be no waiver on licensing his dog.

Motion by Beck to adjourn the meeting, second by Ealy. On roll call all voted aye. Meeting adjourned at 6:31 p.m.
