Council Minutes – July 20, 2009

The regular meeting of the Belle Plaine City Council met on July 20, 2009 at 6:00 p.m. in the city council chambers with Mayor Jim Daily presiding. Present:  Craig Van Scoyoc, Harold Ealy, Marv DeRycke and James Kurovski.  Also present Assistant City Attorney Jennifer Zahradnik and City Administrator Bill Daily.

Motion by Kurovski to approve the consent agenda consisting of council minutes from July 6th, bills @ $ 44,219.55 and the minutes from Planning & Zoning – April 13, May 11 & June 8th, second by Ealy. On roll call all voted aye. Motion carried.

Dangerous Animal Hearing – Mike & Kate Jones 1704 9th Avenue: Jones was present to discuss a nuisance notice issued July 7th to remove his dog. The citation stated that the Jones’ dog was in violation of Section 60.4 of the Code of Ordinances.  Jones said he had the opinion of 3 vets on whether the dog had any pit bull (Staffordshire terrier) in him.  Dr. Cheney, DVM from Victor stated it was his opinion that the dog was indeed a Staffordshire terrier.  Council stated the citation stands as issued and Jones would have to remove the dog from Belle Plaine.

Motion by DeRycke to approve the renewal of Class E Liquor & Sunday sales for Country Foods, second by Ealy. On roll call all voted aye. Motion carried.

Consideration of Action on the Disposition of Alley West of Longfellow School:  A petition had been filed with the City Clerk to “reopen the alley from 7th Avenue to 7th Street”.   Discussion was held at the Committee of the Whole meeting presiding the council meeting.  Motion by Van Scoyoc to leave the alley closed until the school construction is finished and then review this issue again, second by DeRycke. On roll call all voted aye. Motion carried.

Motion by Van Scoyoc approve Resolution #09-7-3 to adopt Boundaries of the Streetscape/Façade Master Plan Project and Approve the Surveys of Buildings and Public Improvements within the Project Area, DeRycke. On roll call all voted aye. Motion carried.

Motion by Kurovski to approve Resolution #09-7-5 to accept bids and award the contracts for the Aquatic Center. Ricchio Inc is awarded Contract #1 for the Pool Construction @ $807,000 (total amount).   Mechanical Inc is awarded Contract #2 Pool Mechanical Construction @ $ 489,000 (total amount). Garling Construction is awarded Contract #3 General Construction @ $786,000 (total amount). Second by Van Scoyoc. On roll call all voted aye. Motion carried.

August 17th at 5:00 p.m. will be the date/time for the next work session. 

Belle Plaine Development Corporation Report – Jon Dayton: Scratched

Belle Plaine Police Chief gave the monthly police report.

City Administrator Report:
      1.  Housing is needed for the Walldogs Event on September 17-20, 2009.  Anyone interested in helping with housing for the artists should contact Bill Daily at City Hall.

      2. Bill said he will not be attending the City Manager’s Conference next week as planned.

Correspondence:  Mayor Daily read a thank you from the McIntire family for remembering former Mayor Jerry McIntire.

Employee Evaluation: City Administrator:  Bill asked for a closed session for his evaluation.  Motion by Ealy to go into closed session according to State Code 21.5 (i) to evaluate an employee, second by Van Scoyoc. Motion carried.  Into closed session 6:22 p.m.

Back into open session at 6:48 p.m.

Motion by Kurovski to approve a 3.2% raise effective July 1, 2009 for City Administrator Bill Daily, second by Ealy. Kurovski, Ealy, Van Scoyoc voted aye. DeRycke abstained from voting. Motion carried.

Motion by Van Scoyoc to adjourn the meeting, second by Ealy. On roll call all voted aye. Meeting adjourned at 6:50 p.m.
