The regular meeting of the Belle Plaine City Council met on September 8, 2009 at 6:00 p.m. in the council chambers with Mayor Jim Daily presiding. Present:  James Kurovski, Marv DeRycke, Harold Ealy, Garrison Reekers and Craig Van Scoyoc.  Also present:  City Attorney Larry Schlue and City Administrator Bill Daily.

Motion by Kurovski to approve the consent agenda consisting of council minutes from August 17th, bills @ $ 97,928.83 and minutes from the Airport Commission – August 6th, Library Board – July 28th & Committee of the Whole- August 17th, second by Ealy. On roll call all voted aye.  Motion carried.

Motion by Ealy to approve Resolution #09-9-1 of Necessity for unpaid bills, second by DeRycke. On roll call all voted aye. Motion carried.

Motion by DeRycke to approve a request from Denise Balvin to close 1st Avenue & 16th Street on October 12th from 3:30 – 7:00 p.m. for the “Make a Wish Fundraiser” Halloween Party, second by Van Scoyoc. On roll call all voted aye. Motion carried.

Representatives from the Belle Plaine Museum were present to ask if the City could help with a water problem at the museum.  According to Bev Winkie there has been extensive water damage in the building. Winkie said they have tried everything they can to come up with a solution. The museum now has 2 sump pumps, dehumidifiers and fans running to help with the drying  process but the building now   has  a mold problem. City Administrator Bill Daily stated it was the plan to help with this water problem during the streetscape project  but that would not be until next spring.  Dean Carl said they should not wait that long to fix the problem.  Council directed staff to get an engineer to look into the problem. 

Motion by Reekers to approve the request from the Belle Plaine Development to close the intersection at 12th Street & 8th Avenue on September 19th from 6:00 p.m. to 1:00 a.m. for a  ” Weekend of Living History” dance, second by Ealy. On roll call all voted aye. Motion carried.

Motion by DeRycke to approve payment #1 to Ricchio, Inc. @ $45,135.00 for the Aquatic Center construction, second by Ealy. On roll call all voted aye. Motion carried.

Motion by Ealy to approve payment #2 to Ricchio, Inc @ $85,993.00 for the Aquatic Center construction, second by Reekers. On roll call all voted aye. Motion carried.

Motion by Van Scoyoc to approve Resolution #09-9-4 authorizing & approving a loan agreement and providing for the sale and issuance of $2,100,000 General Obligation Aquatic Center Bonds, Series 2009A and providing for the levy of taxes to pay the same, second by Ealy. On roll call all voted aye. Motion carried.

Motion by Van Scoyoc to set October 31st from 5:00 – 8:00 p.m. as the date/time for Halloween Trick or Treats, second by Ealy. On roll call all voted aye. Motion carried.

Motion by Van Scoyoc to approve the bid from Dave Schmitt Construction not to exceed $21,551 for 56 lineal feet of storm sewer repair at 5th Avenue & 6th Street, second by Ealy. On roll call all voted aye. Motion carried.

Motion by Ealy to approve the service agreement with East Central Iowa Council of Governments for the preparation and administration of a Community Development Grant for the Fascade Master Plan, second by Van Scoyoc. On roll call all voted aye. Motion carried.

City Administrator Reports:

  1. City Officials will be meeting for the second time with the Community Attractions and Tourism (CAT) Committee in Marshalltown tomorrow.
  2. The Aquatic Facility Project is ahead of schedule.  Hopefully concrete will be laid in the near future.
  3. A letter has been received from Dr. Jeffrey Cheney, Victor,  stating  he is no longer supports his opinion that Mike  Jones’ dog is part American pit bull terrier, American Staffordshire terrier or Pit Bull terrier.  Cheney said he has reviewed the DNA analysis and found no strain of a pit bull.  Previously the Council had instructed  Mike & Kate Jones  ( 1704 9th Avenue) to remove the dog from Belle Plaine.  Police Chief Hudson still feels the dog is part pit bull.  Police Chief Hudson was instructed to write a letter to the Jones and state the DNA analysis must be received  by the City on or before September 21st.
  4. The “Weekend of the Living History”  will soon be here  and there is still a need for 1 more home for the artists.
  5. Bill said the Carole Donovan Estate has given the City over $410,000 to establish and maintain a Carole Donovan Beautification Trust.  The Mayor will be in charge of appointing a Council member for the Board.  A  Master Gardener and Park Board member  will also be appointed to the board.
  6. Bill asked the Council if they would like to revisit the closure of the alley west of Longfellow School.   The Council stated this is a temporary closure during school construction and it will be reevaluated after the construction if finished.
