April 2, 2012
The Belle Plaine City Council met on April 2, 2012 at 6:00 p.m. in the council chambers with Mayor Dave Fish presiding. Present: Marv DeRycke, Garrison Reekers, Mary Pech, April Saunders and James Kurovski. Also present: City Attorney Jennifer Zahradnik and City Administrator Bill Daily.
Roll call was held.
Motion by DeRycke to approve the consent agenda consisting of the March 19th council minutes, bills at $23,814.01, and the receiving/filing of the March 19th Committee of the Whole minutes, March 12th Park Board minutes and the February 28th Library Board minutes, seconded by Kurovski. On roll call, all votes aye. Motion carried.
Residents Comments: Jean Vopalka suggested having Clean-Up Day after the City Wide Garage Sales.
Carol Petersen of the Belle Plaine Partners for Beautification presented a copy of the landscaping plans for the Beautiful Plaines Prairie Park. Planting of trees and shrubs will be April 28th, May 2nd and May 5th. Seeding will be done on May 15th. They will put a “shout out” in the paper for volunteers to help with the planting.
Pit Bull Removal Hearing- Xavier Bailey and Lelia Bray. Bailey and Bray were not present for the hearing. Motion by Reekers to uphold the citation and have the pit bull removed, seconded by Saunders. On roll call, all voted aye. Motion carried.
Motion by DeRycke to approve Plumbers Licenses for Kinzenbaw Earthmoving, Ternus Electric and Cronbaugh Excavating, seconded by Reekers. On roll call, all voted aye. Motion carried.
Motion by Pech to approve the renewal of the Class C Beer, Class B Wine and Sunday Sales permit for Country Foods, seconded by Saunders. On roll call, all voted aye. Motion carried.
Roxanne Smiths’ request for additional time to place dogs – Dan Eggert was present for Smith. They have 2 dogs left from a December litter and 5 new puppies plus 4 adult dogs. They are breeding Bichon Frise at Smith’s house to sell. City Attorney Zahradnik said they are not zoned to sell pups commercially from the home. Motion by DeRycke to uphold the City Code by not allowing Smith to sell pups commercially out of the residential area and to allow Smith 2 weeks to sell the 2 older pups and 10 weeks to sell the 5 new pups. In addition Smith will not be allowed to raise anymore pups after these are gone, seconded by Kurovski. On roll call, all voted aye. Motion carried.
Motion by Saunders approving the Agreement for Services with Mosquito Control of Iowa, Inc. in the amount of $4,950 for Seven Sprayings, seconded by DeRycke. On roll call, all voted aye. Motion carried.
Motion by Reekers Authorizing Aerial Application for Mosquito Control with Aviation Specialties, seconded by Saunders. On roll call, all voted aye. Motion carried.
Motion by Pech to designate May 7th as Clean-Up Day, seconded by Saunders. On roll call, Pech voted aye, Saunders voted aye, Reekers voted nay, DeRycke voted nay and Kurovski voted nay. Motion failed.
Motion by DeRycke to approve Resolution #12-4-1 Accepting the Work on the Snow Removal Equipment Storage Building Project for the Belle Plaine Municipal Airport and Authorizing the Payment of $8,458.91 (Retainage) to Garling Construction, seconded by Reekers. On roll call, all voted aye. Motion carried.
Motion by Reekers to approve Resolution #12-4-2 Approving Partial Payment #13 Relating to the Downtown Revitalization Project in the amount of $72,905.85 to Garling Construction, seconded by Pech. On roll call, all voted aye. Motion carried.
City Administrator’s Reports:
- Daily gave an update of the Downtown Revitalization Project. Brownsfield is 80% completed and the project will be finished before July 1, 2012. The ribbon cutting ceremony will be announced at a later date.
- Daily reported that final notices were sent out for those who have not registered dogs and cats. Due date is April 15th. Next step will be a Letter of Hearing to appear before the City Council.

Motion by Kurovski to adjourn the meeting, seconded by Pech. On roll call, all voted aye. Meeting adjourned at 7:16 p.m.
