SECTION 3-28-1                  INJURING OR DEFACING CITY PROPERTY.  It shall be unlawful for any person within the corporate limits of this City, without permission from the City, to deface, injure, or destroy, or assist in defacing, injuring or destroying any building, bridge, paving, sidewalk or crosswalk, drain or sewer, or any part thereof, or any other property belonging to the City; or to injure or obstruct the making or repairing of any improvement or work ordered by the City.

SECTION 3-28-2                  INJURING OR DEFACING PROPERTY. It shall be unlawful for any person within the corporate limits of this City to cut, hack, deface with paint or chemicals, or in any manner injure any awning, grade stake, grave marker or monument, lamp post, gas or water pipe, tree, plant, flower or shrub, railing, fence or any other property not owned by him.

SECTION 3-28-3                  INJURING OR DEFACING OR REMOVING SIGNS, MARKERS AND GRADE STAKES. It shall be unlawful for any person within the corporate limits of this City to remove, deface, destroy, injure or alter in any way any notice, street sign, street marker, traffic sign, street or sidewalk barricade, warning light or signal, grade stake, stone, fence mark or monument set by or under authority of the City Council.

SECTION 3-28-4                  POSTING SIGNS. It shall be unlawful for any person to post, nail, paste, paint, print, or by any means or in any manner affix any show bill, handbill, sign, advertisement, notice or other written or printed matter, notices or signs, upon or against any building or other structure or improvement without the consent of the owner or occupant of such building, structure or improvement, or any part thereof, without the consent of the owner or occupant thereof. Further, it shall be unlawful for any person to paint, print, write, paste or in any manner affix any advertising matter or sign upon any bridge, sidewalk, street crossing, telephone or electric light pole, or other construction in, upon or along any street, avenue, alley, highway or public place.

SECTION 3-28-5                  CRUELTY TO ANIMALS.  It shall be unlawful for any person, within the corporate limits of this City to torture, torment, deprive of necessary sustenance, mutilate, overdrive or override, cruelly beat, or cruelly kill any animal or unnecessarily fail to provide the same with proper food, drink, shelter or protection from the weather, or drive the same when unfit for labor, or cruelly abandon the same, or carry or cause the same to be cruelly carried on any vehicle or otherwise.

SECTION 3-28-6                  RAISING LIVESTOCK WITHIN CITY LIMITS PROHIBITED  It shall be unlawful for any person to keep within the corporate limits of this City all cattle, swine, sheep, goats, or fowl (including chickens, geese, ducks and pigeons); the restriction herein imposed shall not be applicable to persons legally keeping or raising such animals within the corporate limits as September 22, 1977.

SECTION 3-28-7                  HORSES TO BE KEPT ON STREETS AND NOT ON PRIVATE PROPERTY. It shall be unlawful to drive, lead or ride a horse within the limits of this City except on the surfaced portions of public streets and in alleyways. No horses shall be driven, led or ridden over or across privately owned or non-public property except with the consent of the owner thereof or his representative.

SECTION 3-28-8                  PROHIBITING PASTURING OR HARBORING OF HORSES WITHIN CERTAIN DISTRICTS.  No owner or person in possession of real estate within the limits of Belle Plaine, Iowa, shall pasture or harbor any horse or horses in areas zoned R-1, R-2, or R-3 unless the lot, lots, or parcels of land on which such horse or horses are pastured or harbored contain an area of not less than 15,000 square fee; where such area consists of more than one lot or parcel, such lot or parcel must constitute one contiguous tract. The term “owner” shall be defined to mean the person, persons, or organizations who are the record titleholders of said real estate as shown by the record of the County Auditor.

SECTION 3-28-9                  PROHIBITING KILLING OR INJURING OR OF BIRDS AND SQUIRRELS.  It shall be unlawful for any person, within the City of Belle Plaine, Iowa, to kill or attempt to kill, injure, or destroy any  bird, or any timber squirrel, by shooting, stunning, trapping, poisoning, or in any other manner whatever.

SECTION 3-28-10                SAME. It shall be unlawful for any person, within the City of Belle Plaine, Iowa to molest, injure, or destroy, or attempt to molest, injure, or destroy, any bird at any time between the first day of March and first day of October in any year.

SECTION 3-28-11                PERMIT TO DESTROY PEST.  Upon the petition of any resident householder of this city, showing that certain birds, rabbits, gophers, rats or certain squirrels have become a pest, the Mayor may, in his discretion, issue a permit for the destruction of a certain number of such birds, rabbits, gophers, rats or squirrels on the premises of the petitioner.

SECTION 3-28-12                PROHIBITING USE OF PUBLIC AND PRIVATE DUMPSTERS AND TRASH AND GARBAGE RECEPTACLES FOR USE FOR PRIVATE HOUSEHOLD OR BUSINESS PURPOSED BY NONOWNERS OR LESSORS.  It shall be unlawful for any person, firm or organization to deposit any household or business garbage, refuse, or other wastes into any dumpster or trash or garbage receptacle in any park or on any public right of way or to make such deposit to any dumpster or trash or garbage receptacle not owned or leased by the depositor
