SECTION 3-40-1                  DEFINITIONS. For the purpose of this Chapter, the following definitions shall apply:

(1)   Crosswalk-shall include that portion of a street ordinarily included within the prolongation of the sidewalk lines at intersections, or any other portion of a roadway clearly indicated for pedestrians’ crossing by lines or other marks on the surface.

(2)   Driver-shall include every person who drives or is in actual physical control of a vehicle.

(3)   Emergency Vehicle-shall include fire trucks and vehicles when responding to an emergency call, and police cars when engaged in responding to an emergency, when engaged in the pursuit of or attempting to apprehend a person who has committed a public offense or when attempting to prevent a public offense.

(4)   Intersection-shall include the area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two angles or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict.

(5)   Motor Vehicle-shall include all self propelled vehicles and every car, bus, truck, motorcycle, motorbike, scooter, golf cart, snowmobile, tractor, or similar device except trains.

(6)   Pedestrians-shall include persons who proceed on foot or occupy wheel chairs or like conveyance motivated by pedestrians.

(7)   Sidewalk-shall include that portion of a street between the curb lines adjacent to property lines ordinarily intended for the use by pedestrians.

(8)   Street-shall include every street, avenue, boulevard, highway, roadway, lane, alley, square, bridge, or place laid out for the use of vehicles.

(9)   Traffic-shall include pedestrians, ridden or herded animals, vehicles, streetcars, and other conveyances either singly or together while using any highway for purposes of travel.

(10)   Vehicle-shall include every motor vehicle, car, truck, bus, trailer, motorcycle, tricycle, motorbike, mini-bike, led or ridden horse, and every other device or conveyance on wheels or runners except trains.

(11)  Thru Traffic–shall be defined as traffic that is initiated at a point outside of the designated zone and does not have a destination within the zone designated as no thru traffic.

SECTION 3-40-2                  AUTHORITY OF POLICE OFFICERS. The provisions of this ordinance not withstanding, police officers of this City are authorized to direct and control all vehicle, pedestrian or other traffic either in person or by visible or audible signals when such direction and control is required by reason of emergency, when required to enforce the provisions of this Chapter, or for heavy traffic or to safeguard pedestrians or others.

SECTION 3-40-3                  FAILURE TO OBEY POLICE OFFICER.  Failure to obey the directions, command or signals of a police officer while directing, regulating or controlling traffic shall constitute a violation of this ordinance.

 SECTION 3-40-4                  TRAFFIC CONTROL AUTHORITY OF FIRE DEPARTMENT MEMBERS.  Duly authorized members of the Belle Plaine Volunteer Fire Department may, in the event of a fire, direct, control, prohibit and restrict traffic as may be required for effectual fire fighting and control purpose; said fire department members shall have concurrent authority with police officers when acting under the authority granted by this section and violations shall be punishable as that provided for failure to obey police officers.

 SPEED DISTRICTS AND RESTRICTIONS

 SECTION 3-40-5                  SPEED DISTRICTS.  The following districts are defined for the purpose of determining the applicability of speed restrictions as determined by the laws of the State of Iowa:

 (1)    Business District: all of that part of Twelfth Street between Seventh Avenue and Twelfth Avenue and all that part of Eighth, Ninth, Tenth and Eleventh Avenues between Eleventh Street and Thirteenth Street.

 (2)   School District: all streets and avenues within 200 feet of any school building or building used for school purposes.             

 (3)   Suburban District:  so much of Seventh Avenue and Thirteenth Street as comprises Iowa State Highways 212 and 21; so much of Thirteenth Street as comprises Highway 131; so much of Thirteenth Avenue as extends north from Sixteenth Street to the north city limits; so much of First Street as extends east from Seventh Avenue to the east city limits, and so much of First Avenue as extends north of Sixteenth Street to the north city limits; all speed limits in the suburban district shall be subject to the speed limits designated by appropriate signs as decide by  agreement and approved by the Iowa Department of Transportation and the City of Belle Plaine.

 (4)   Residential District: All streets and avenues not included within a business district, school district, or suburban district.

 (5)   Heavy Industrial District:

         (a)   No person shall operate a motor vehicle on Industrial Park Boulevard in excess of 25 miles per hour.

          (b)   No person shall operate a motor vehicle on Third Street in excess of 25 miles per hour.  

 (6)   Thirteenth Avenue:  No person shall operate a motor vehicle from the eastern corporate limits to Thirteenth Avenue in excess of 35 miles per hour and from Thirteenth Avenue west to Seventh Avenue in excess of 30 miles per hour.

 SECTION 3-40-6                  SPEED RESTRICTIONS IN PARKS.  No person shall operate a motor vehicle in any park in this City in excess of 10 miles per hour.

 SECTION 3-40-7                  EXCEPTIONS-AUTHORIZED VEHICLES.  The provisions of this ordinance regarding speed restrictions and obedience to signs and signals shall not apply to the following: (1) to fire trucks and vehicles when responding to or returning from a fire, (2) to ambulances when engaged in responding to an emergency call, and (3) police cars when engaged in responding to an emergency call, when engaged in the pursuit of or attempting to apprehend a person who has committed a public offense or when attempting to prevent a public offense.

                                                      SIGNS AND SIGNALS 

SECTION 3-40-8                  ERECTION AND MAINTENANCE OF SIGNS.  It shall be the duty of the Public Works Director of this City to erect and maintain all official traffic signs and signals as required by the ordinances of this City. All signs and signals shall comply with the uniform system of traffic control devices as adopted by the Iowa State Highway Commission.

SECTION 3-40-9                  OBEDIENCE TO TRAFFIC SIGNS AND SIGNALS. It shall be unlawful for the driver of any vehicle to disobey the instructions or signals of any official traffic control device sign or signal placed in accordance with the provisions of this Chapter unless otherwise directed by a police officer.

SECTION 3-40-10                DEFACING, DAMAGING OR OBSTRUCTING SIGNS. It shall be unlawful for any person to willfully deface, injure, move, obstruct or tamper with any official sign, signal or control device.

SECTION 3-40-11                UNAUTHORIZED SIGNS. It shall be unlawful for any person to place, maintain or display any unofficial sign, signal or device which resembles or purports to be an official sign or which attempts to direct the movement of traffic on any public street or which hides or obstructs any official sign or signal.

RIGHT OF WAY

SECTION 3-40-12                RIGHT OF WAY OF EMERGENCY VEHICLES.  Emergency vehicles as herein defined shall have the right of way over all other vehicles, and it shall be unlawful for the operator of any other vehicle of any other vehicle to fail, refuse or neglect to yield the right of way to such vehicles.

SECTION  3-40-13               STOP INTERSECTIONS AND RIGHT OF WAY.  It shall be unlawful to drive any vehicle into any intersection designated as a stop intersection without first bringing such vehicle to a full stop. The City Council may, from time to time by resolution designate the intersections to which this section shall apply. 

SECTION 3-40-14                RIGHT OF WAY AT YIELD INTERSECTIONS.  The driver of a vehicle approaching a yield sign shall in obedience to such sign slow down to a speed reasonable for the existing conditions or shall stop if necessary and shall yield the right of way to any pedestrian legally crossing the roadway on which he is driving and to any vehicle in the intersection or approaching on another highway or public street so closely so as to constitute a hazard, and except at such yield intersections or intersection marked with a stop sign or traffic signal, when two vehicles enter an intersection from different highways or public streets at approximately the same time, the driver of the vehicle on the left shall yield the right of way to the vehicle on the right. The City Council may, from time to time, by resolution designate such intersections to which this section shall apply.

SECTION 3-40-15                TO YIELD RIGHT OF WAY WHEN BACKING.  Operators of vehicles shall, when backing in any public street, yield the right of way to other vehicle, animal and pedestrian traffic and shall not proceed to back up unless there is sufficient space to make said backing movement with safety.

SECTION 3-40-16                YIELDING ONE-HALF OF TRAVELED PORTION OF STREET.  Persons on horseback and the operators of all vehicles shall upon meeting each other on a public street or alley yield one-half of the traveled portions thereof by turning right.

SECTION 3-40-17                TURNING AT INTERSECTIONS.

(1)   Right Turns.  The operator of a vehicle intending to turn to the right at an intersection, or into an alley or driveway, shall approach the point of turning in the traffic nearest the right hand edge or curb of the street, and in turning shall keep as close as practicable to the right hand curb or edge of the street.

(2)   Left Turns.  The operator of a vehicle intending to turn to the left at an intersection or into an alley or driveway shall approach the point of turning in the traffic just to the right of and next to the center of the roadway, and unless otherwise directed by “turning markers” the operator of a vehicle in turning left at an intersection shall pass to the right of the center of the intersection before turning.  

SECTION 3-40-18                PASSING AT INTERSECTIONS.  It shall be unlawful for the operator of any motor vehicle to overtake and pass another vehicle at the street intersections in any portion of Belle Plaine, Iowa.

SECTION 3-40-19                STOPPING VEHICLES ON APPROACH OF AUTHORIZING EMERGENCY VEHICLES.  Upon the approach of any emergency vehicle giving audible signal by bell, siren, or whistle, the operator of every other vehicle shall immediately drive the same to a position as near to the edge of roadway, and shall stop and remain in such position until the emergency vehicles shall have passed unless otherwise directed by a police officer or officers of the fire department.

SECTION 3-40-20                FOLLOWING EMERGENCY VEHICLES.  It shall be unlawful for driver or operator of any vehicle to follow any emergency vehicle within three hundred feet thereof.

SECTION 3-40-21                FUNERAL PROCESSIONS.  It shall be unlawful for any person to obstruct the passage along any street of any funeral procession, or impede or obstruct the passage of any person attending the conveyance of a body, of any deceased person, to place of interment.

SECTION 3-40-22                RIGHT OF WAY – ENTERING STREET FROM ALLEYS, DRIVES AND CROSSING SIDEWALKS.  The driver of a vehicle emerging from a private roadway, alley, driveway, or building shall stop such vehicle immediately prior to driving onto the sidewalk area and thereafter he shall proceed into the sidewalk area only when he can do so without danger to pedestrian traffic and he shall yield the right of way to any vehicular traffic on the street into which his vehicle is entering.

SECTION 3-40-23                RIGHT OF WAY – PEDESTRIANS.  Where traffic control signals are not in place or in operation the driver control signals are not in place or in operation the driver of a vehicle shall yield the right of way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.

USE OF PUBLIC STREET, ALLEYS AND SIDEWALKS

SECTION 3-40-24                DRIVING OR RIDING ON SIDEWALKS.  It shall be unlawful for any person to drive, push or tow any motor vehicle on any public sidewalk except to cross at a driveway or street intersection. It shall be unlawful for any person to ride, lead or drive any horse on a public sidewalk except to cross at a driveway or street intersection.

SECTION 3-40-25                GOLF CARTS.  Persons possessing a valid driver’s license may operate a golf cart upon the city streets in the manner allowed under Section 321.247 of the Iowa Code and subject to the following terms and conditions.

(1)   A golf cart shall not be operated upon a city street which is a primary road extension through the city but shall be allowed to cross a city street which is a primary road extension through the city.

(2)   The golf carts shall be equipped with a slow moving vehicle sign and a bicycle safety flag.

(3)   The golf cart shall operate on the streets only from sunrise to sunset.

(4)   Golf carts operated on city streets shall be equipped with adequate brakes.

SECTION 3-40-26                HORSES PROHIBITED IN BUSINESS DISTRICT.  It shall be unlawful for any person to ride, lead or drive any horse on all of that part of Twelfth Street between Seventh Avenue and Twelfth Avenue and all that part of Eighth, Ninth, Tenth and Eleventh Avenues between Eleventh Street and Thirteenth Street, with the exception of parades or special events.

SECTION 3-40-27                BURNING.  No person shall burn any trash, rubbish, leaves, wood or accumulations of other materials on any public street or sidewalk of this City.

SECTION 3-40-28                STORAGE AND DISPLAY.  No person shall use a public street or sidewalk as a storage area or display area for the purpose of selling goods, merchandise or equipment or temporarily encroach on a public sidewalk for a distance of not more than thirty-six inches from the right of way line for the purpose of displaying goods and merchandise for sale without special permission of the City Council or their representative.  

SECTION 3-40-29                VEHICLE SIZE LIMITATIONS WHERE ANGLE PARKING IS ALLOWED. No motor truck, light delivery truck, panel delivery truck or pickup truck with a gross weight registration of one ton or more or of a width greater than six feet shall be parked at any time within the City of Belle Plaine, except where parallel parking is permitted, that is, no truck of said description shall be parked at an angle at any time within said City of Belle Plaine, Iowa.  

SECTION 3-40-30                VEHICLE SIZE LIMITATION ON TWELFTH STREET – AS TO USE.  It shall be unlawful to operate upon that portion of Twelfth Street in the City of Belle Plaine between the east line of Seventh Avenue and the intersection of the paving of Twelfth Street with the paving on Thirteenth Street any truck or other vehicle which weighs or which together with its load weighs over five tons, said limitation shall not apply to buses or to trucks delivering merchandise on Twelfth Street.

SECTION 3-40-31                VEHICLE SIZE LIMITATION ON NINTH STREET – AS TO USE. The use of Ninth Street in the City of Belle Plaine, Iowa, between Fourth Avenue and Tenth Avenue by trucks having a gross total weight in excess of five tons is hereby prohibited and declared to be a misdemeanor

PARKING, STANDING OR STOPPING 

SECTION 3-40-32                STOPPING OR PARKING IN PROHIBITED PLACES.  It shall be unlawful for the operator of any vehicle to stop, stand, or park such vehicle, or for any person to park any motorcycle, snowmobile, motorized golf cart, tractor, car, truck or other vehicle in any of the following places (and as regulated by Chapter 28 of this Code), except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal:

 (1)   Within an intersection.

 (2)   On a crosswalk.

 (3)   Within twenty (20) feet of the driveway entrance to the fire station.

 (4)   Within five (5) feet of a fire hydrant.

(5)   In front of a private garage or driveway, unless occupied by a competent driver or operator.

(6)   On a sidewalk. 

(7)   Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.

(8)   Within fifteen (15) feet of either side of the entrance of any hotel, theatre, auditorium or other building.

(9)  At any place where official signs prohibit stopping or parking.

(10)  On any public right-of-way between the curb and the adjoining sidewalk or on any city right -of-way, except the traveled portion thereof and as allowed by ordinance where no sidewalk or curb exists, except when such vehicle is parked in a driveway and only when not protruding over or across the sidewalk or beyond the curb or into the traveled portion of the public street where there is no curb.

(11)  In any front yard as defined by Chapter 86 (Zoning Ordinance) of the Belle Plaine Municipal Code in any District zoned R-1, R-2, R-3 and R-4.

(12)   In any alley in the business district at any time, except for loading and unloading, or to park a vehicle in any alley in any other part of the City.

SECTION 3-40-33                PARALLEL AND ANGLE PARKING – WHEN PERMITTED. Except upon such streets as are hereinafter expressly designated and described parallel parking shall be observed, and it shall be unlawful for the driver or operator of any vehicle to stop, stand or park such vehicles on any street in the City of Belle Plaine, Iowa, with the exception of such streets as are hereinafter expressly designated, unless both wheels on the right side of such vehicle are next to and parallel with the curb and within eighteen inches of a paved curb or as near thereto as the condition of the street will permit where there is no paved curb. This section shall not apply to cases of emergency or when the stop is made to avoid accident, or allow pedestrians or vehicles to cross in front of such vehicle, or when made in obedience to the lawful orders of police officers or officers of the fire department. The streets upon which angle parking shall be permitted are as follows:

(1)   On both sides of Twelfth Street in said City, between Seventh Avenue and Tenth Avenue in said City, all vehicles shall be parked at an angle of 45 degrees, the line of the sidewalk thereof being the base upon which such angle shall be computed.

(2)   On the east side of Ninth Avenue in said City between Eleventh and Thirteenth Streets, all vehicles shall be parked at an angle of 45 degrees.

(3)   On the west side of Ninth Avenue in said City between Eleventh and Thirteenth Streets, all vehicles shall be parked at an angle of 45 degrees.

(4)   On the South side of Sixteenth Street between Seventh and Eighth Avenues where paved surface has been widened to more than 23.5 feet.

(5)   On the North side of  Eleventh Street the area East of Seventh Avenue where paved surface has been widened.

SECTION 3-40-33-1              PARALLEL PARKING ONLY.  Except as provided in Section 3-40-33, the following street(s) shall now be observed as parallel parking only.

1.  Eight Avenue from Thirtenth Street to Sixteenth Street on both sides of the road.

SECTION 3-40-34                PARKING REGULATIONS – CITY PARKING LOT, EIGHTH AND ELEVENTH STREET  All parking in the city parking lot at the intersection of Eighth Avenue and Eleventh Street in the City of Belle Plaine shall be at 90 degree angles with the north and south boundaries of said parking lot and within painted or marked areas designated for parking.

 

SECTION 3-40-35               NO PARKING ON STREETS FOR STORAGE OR DURING CERTAIN HOURS. No vehicle shall be parked on any street or alley of the City of Belle Plaine for a longer period of time than twenty-four (24) hours, nor shall there be any parking whatsoever from two o’clock a.m. to five o’clock a.m. in the following area of said City.

(1)   Twelfth Street from Seventh Avenue to Eleventh Avenue.

(2)   Eighth Avenue from Eleventh Street to Thirteenth Street.

 

 

(3)   Ninth Avenue from Eleventh Street to Thirteenth Street.

The four parking spaces on the West side of the Belle Plaine Area Museum locate on Ninth Avenue between the railroad tracks and Twelfth Street are exempt from Section 3-40-35 of the Belle Plaine Code of Ordinances. This area is not subject to the City Snow Emergency Ordinance Chapter 42.

 

Any vehicle found to be in violation of the provisions of this section shall be towed away and the expense thereof charged to the vehicle owner and the owner shall be found guilty of a misdemeanor.

SECTION 3-40-36                NO PARKING OF TRUCKS LICENSED FOR TEN TONS GROSS WEIGHT OR MORE ON PUBLIC RIGHT OF WAYS.  No truck licensed for ten tons gross weight or more shall be allowed to park on the public right of way within the corporate limits for a period of more than thirty minutes, unless such truck is being used for the purpose of loading or unloading in acts directly related to construction. 

SECTION 3-40-37                DOUBLE PARKING PROHIBITED.  It shall be unlawful to park two (2) vehicles abreast, however briefly, either traveling in the same or opposite directions, upon the main traveled portion of the streets or highways of the City of Belle Plaine, Iowa, except in case of emergency or when a stop is made to a void accident in front of such vehicle, or when made in obedience to the order of the police.

SECTION 3-40-38                STOP  INTERSECTIONS.  It shall be unlawful to drive any vehicle into any intersection designated as a stop intersection without first bringing such vehicle to a full stop. Those intersections designated as stop intersections are the intersections of:

                      Sixth Avenue entering Third Street from the North.

                      First Street entering Seventh Avenue from the East.

                      First Street entering Thirteenth Avenue from the West.

                      Third Street entering Seventh Avenue from the East.

                      Fourth Street entering Seventh Avenue from the East.

                      Fifth Street entering Seventh Avenue from the West.

                      Sixth Street entering Seventh Avenue from the East.

                      Sixth Street entering Third Street from the North.

                      Seventh Street entering Seventh Avenue from the East and West.

                      Eighth Street entering Seventh Avenue from the East and the West.

                      Ninth Street entering Seventh Avenue from the East and the West.

                      Ninth Street entering Tenth Avenue from the East and the West.

                      Tenth Street entering Seventh Avenue from the East and the West.

                      Tenth Street entering Tenth Avenue from the East and the West.

                      Eleventh Street entering Seventh Avenue from East and the West.

                      Eleventh Street entering Thirteenth Avenue from the West.

                      Thirteenth Street entering Seventh Avenue from the East and the West.

                      Fifteenth Street entering Eighth Avenue from the East and the West.

                      Fifteenth Street entering Ninth Avenue from the East and the West.

                      Fifteenth Street entering Iowa Highway 21 from the East.

                      Fifteenth Street at either of two junctions entering Twelfth Street Extension

                                    (V40) from the North and the West.

                      Fifteenth Street entering Thirteenth Avenue from the East and the West.

                      Fifteenth Street entering Sunset Drive from the East and the West.

                      Sixteenth Street entering First Avenue from the East and the West.

                      Sixteenth Street Fifth Avenue entering from the East and the West.

                      Sixteenth Street entering Seventh Avenue from the East and the West.

                      Sixteenth Street entering Eighth Avenue from the East and the West.

                      Sixteenth Street entering Ninth Avenue from the East and the West.

                      Sixteenth Street entering Eleventh Avenue from the East and the West.

                      Sixteenth Street entering Thirteenth Avenue from the West.

                      Seventeenth Street entering Seventh Avenue from the East and the West.

SECTION 3-40-39                MOVABLE SCHOOL STOP SIGN.  There is hereby established a movable sign at the marked crosswalk between Lee and Lincoln School Buildings  and on  Ninth Avenue between Fifteenth and Sixteenth streets; such stop sign shall be in effect only on such days and during the hours that an authorized stop sign is exhibited in place; said sign is authorized to be in place only during that part of the year when school classes are held and during hours commencing not more than thirty minutes before school opens and extending through the school day to not more than thirty minutes after school classes are dismissed for the day. The driver of a vehicle shall stop at a point ten feet from the approach side of said crosswalk when said sign is in place and thereafter proceed in a careful and prudent manner.

SECTION 3-40-40                ESTABLISHING MOVABLE STOP SIGN.

Repealed on October 15, 2012

SECTION 3-40-41        YIELD INTERSECTIONS. The driver of a vehicle approaching a yield sign shall in obedience to such sign slow down to a speed reasonable for the existing conditions or shall stop if necessary and shall yield the right of way to any pedestrian legally crossing the roadway on which he is driving, and to any vehicles in the intersection or approaching on another roadway so closely as to constitute a hazard. Said driver having so yielded may proceed with caution. The following are designated as yield intersections:

ONE WAY STREETS, ALLEYS AND NO PARKING ZONE 

SECTION 3-40-42        DESIGNATING CERTAIN ONE WAY STREETS AND ALLEYS.

The following streets and alleys are limited to one way traffic for all vehicles and bicycles.

There shall be no vehicle traffic on Twelfth Street between Seventh Avenue and Ninth Avenue except from the West to the East. There shall be no bicycle or vehicle traffic on that part of South Twelfth Avenue which extends North from Eighth Street to Franklin Park and the public pool except from the North to the South, and there shall be no bicycle or vehicle traffic exiting from Franklin Park East to Thirteenth Avenue.

Twelfth Street between Seventh Avenue and Ninth Avenue from West to East.

Twelfth Avenue between Eighth Street and Franklin Park and the public pool except from North to South.

Fifteenth Street from Twelfth Avenue to Thirteenth Avenue from West to East.

Seventh Street between Seventh Avenue and Ninth Avenue from West to East.

Franklin Park from Thirteenth Avenue from West to East.

Conviction of a violation of this section shall be punishable as a misdemeanor.

SECTION 3-40-43        ONE WAY STREETS AND ALLEYS AND SIGNS SO DESIGNATING.   The City Council may from time to time by resolution prohibit vehicles from moving or traveling in more than one direction over or upon any street or alley in the city direction over or upon any street or alley in the city limits and may designate which direction such travel will be permitted. When the direction of travel on any street or alley is limited, signs shall be erected and maintained designating the direction of travel allowed.

SECTION 3-40-44        NO PARKING ZONES.  There shall be no parking the following designated areas:

Third Street: The South side of Third Street from Fourth Avenue to Seventh Avenue.

Fourth Street: No parking on the South side of Fourth Street from Fourth Avenue to Seventh Avenue.

Fifth Street: No parking on the South side of Fifth Street from Fourth Avenue to Seventh Avenue.

Sixth Street: No parking on the South side of Sixth Street form Fourth Avenue to Seventh Avenue.

Seventh Street:  No parking on both sides of Seventh Street from Seventh Avenue to Eighth Avenue (except angle parking is allowed on the South side of Seventh Street where widened), and no parking on the North side of Seventh Street between Eighth Avenue and Ninth Avenue.

Seventh Street: The South side of Seventh Street from Fourth Avenue to Seventh Avenue.

Eighth Street: No parking on the South side of Eighth Street between First Avenue and Thirteenth Avenue; no parking on the North side of Eighth Street between Second Avenue and Seventh Avenue.

Ninth Street:  No parking on the North side of Ninth Street between Tenth Avenue and Eleventh Avenue.

Ninth Street: No parking on that portion on the South side of Ninth Stret between Sixth and Seventh Avenues which commences at the southwest corner of the paved portion of Seventh Avenue and Ninth Street and extends Westerly for a distance of 62.5 feet.

Tenth Street: No parking on the South side of Tenth Street from Fourth Avenue to Tenth Avenue.                  

Eleventh Street: No parking on either side of Eleventh Street between First Avenue and Seventh Avenue.

Eleventh Street: No parking on the South side of Eleventh Street between First Avenue and Seventh Avenue.

Thirteenth Street: No parking on the South side of Thirteenth Street between the two access and exit drives between Ninth Avenue and Tenth Avenue to the Casey’s General Store side: said no parking area is also described as the area on the South side of Thirteenth Street between Ninth Avenue and Tenth Avenue 157 feet East of the center line of Ninth Avenue to a point 197 feet East of said center line of Ninth Avenue.

Fourteenth Street:  No parking from Fifth Avenue to Seventh Avenue on the south side of the street; no parking from Eleventh Avenue to Twelfth Avenue on the south side of the street.

Fifteenth Street: No parking on the South side of Fifteenth Street from Seventh Avenue to Ninth Avenue; no parking on the South side of Fifteenth Street from Eleventh Avenue to Twelfth Avenue; no parking on the North side between Ninth Avenue and Tenth Avenue.

Sixteenth Street:  No parking between Eleventh and Twelfth Avenue on either side.

Sixteenth Street: From the Southwest corner of the intersection of Eleventh Avenue and Sixteenth Street no parking on the South side of Sixteenth Street for a distance of 300 feet West.

Sixteenth Street:  No parking on the South side of Sixteenth Street between First Avenue and Seventh Avenue; no parking on both sides of Sixteenth Street from Eighth Avenue to Tenth Avenue; no parking on the South side of Sixteenth Street between Eleventh Avenue and Thirteenth Avenue; no parking on the North side of Sixteenth Street between Seventh Avenue to Eighth Avenue.

Sixteenth Street: No parking on the North side of Sixteenth Street from Eighth Avenue to Ninth Avenue between the hours of 8:00 A.M. and 4:00 P.M. on any day while school is in session; the North side of Sixteenth Street from Ninth Avenue to Tenth Avenue; and the South side of Sixteenth Street between Eighth Avenue to Ninth Avenue and the Westerly thirty feet on the south side of Sixteenth Street between Ninth Avenue and Tenth Avenue.

Seventeenth Street: No parking on the South side of Seventeenth Street from Fifth Avenue to Seventh Avenue; no parking on the North side of Seventeenth Street between Seventh Avenue and Eighth Avenue.

Eighteenth Street: No parking on the South side of Eighteenth Street from Eighth Avenue to Eleventh Avenue.

Nineteenth Street: No parking on the South side of Nineteenth Street from Seventh Avenue to Eleventh Avenue.

First Avenue:  No parking on the West side of First Avenue between Eighth Street and Tenth Street.

First Avenue: No parking on the West side of First Avenue between Thirteenth Street to Sixteenth Street.

Second Avenue:  No parking on the East side of Second Avenue between Thirteenth and Sixteenth Streets.

Third Avenue:  No parking on the East side of Third Avenue between Thirteenth Street and Sixteenth Street.

Fourth Avenue:  No parking on the East side of Fourth Avenue between Sixth Street and Eighth Street from the hours of 8:00 a.m. to 5:00 p.m.; no parking on the west side of South Avenue between Sixth Street and Eighth Street; no parking on the East side of Fourth Avenue between Thirteenth Street and Sixteenth Street; no parking on the West side of Fourth Avenue from its junction with Fifteenth Street, thence North for a distance of 185 feet; no parking on the East side between Eighth Street and Eleventh Street.

Fourth Avenue: No parking on the East side of Fourth Avenue from Third Street to Sixth Street.

Fifth Avenue: No parking on the East side of Fifth Avenue between Sixth Street and Seventh Street; no parking on the East side of Fifth Avenue between Thirteenth Street and Seventeenth Street; no parking on the East side between Eighth Street and Eleventh Street.

Fifth Avenue: No parking on the East side of Fifth Avenue from Third Street to Sixth Street.

Fifth Avenue: The East side of Fifth Avenue from Seventh Street to Eighth Street.

Sixth Avenue: No parking on the East side of Sixth Avenue between Thirteenth Street and Sixteenth Street; and no parking on the East side between Eighth Street and Eleventh Street.

Sixth Avenue: No parking on the East side of Sixth Avenue from Third Street to Sixth Street and from Sixth Street to Eighth Street.

Industrial Park Boulevard:  Both sides from Fourth Avenue West and South to the end of the paved portion thereof.

Seventh Avenue:  No parking on both sides of Seventh Avenue from First Street to Thirteenth Street; no parking on the East side of Seventh Avenue from Thirteenth Street to Seventeenth Street; and no parking on the West side of Seventh Avenue from Fifteenth Street to Sixteenth Street; and no parking on the West side of the Seventh Avenue commencing at its intersection with Thirteenth Street and extending North a distance of 117 feet.

Seventh Avenue: No parking on the West side and the East side of Seventh Avenue from the intersection of Seventh Avenue and Thirteenth Street to the intersection of Seventh Avenue and Fifteenth Street.

Eighth Avenue: No parking on the East side of Eighth Avenue from Seventh Street to Eleventh Street, and no parking on the East side of Eighth Avenue from Fourteenth Street to Nineteenth Street.

Eighth Avenue: No parking on the West side of Eighth Avenue South of its intersection with Fifteenth Street for a distance of 67 feet South of the center line of Fifteenth Street.

Ninth Avenue: No parking on the East side of Ninth Avenue from Seventh Street to Eleventh Street; no parking on the East side of Ninth Avenue from Sixteenth Street to Nineteenth Street; there shall be no parking on either side of Ninth Avenue in the North one-half of the block between Fifteenth Street and Sixteenth Street between the hours of 8:00 a.m. and 4:00 p.m. on any day of the year while school is in session.

Tenth Avenue; no parking on the East side of Tenth Avenue between Eighth Street and Eleventh Street; no parking on the East side of Tenth Avenue between Thirteenth Street and Fifteenth Street; no parking on the East side of Tenth Avenue between Sixteenth Street and Twenty-first Street.

Eleventh Avenue: No parking on the East side of Eleventh Avenue from Thirteenth Street to Nineteenth Street.

Twelfth Avenue: No parking on the East side of Twelfth Avenue between Fifteenth Street and Sixteenth Street.

Thirteenth Avenue: No parking from Thirteenth Street to Fifteenth Street on both sides of the street.

Rainbow Drive: No parking on the East and South sides of Rainbow Drive.

Sunset Drive: No parking on the East and South sides of Sunset Drive; no parking on either side of Sunset Drive between Twelfth Street Extension and Fifteenth Street.

There shall be no parking in such other areas as are designated by Chapter 40 of this code.  There shall be no parking in any alley except to load and unload.

SECTION 3-40-45                LIMITED PARKING.  The third and fourth parking spaces on the north side of Twelfth Street east of its intersection with Ninth Avenue are hereby limited to use for parking for fifteen consecutive minutes only during hours that the Belle Plaine Community Library is open for public use; such limited parking shall be in effect only when that space is marked by a sign designating the limited parking time herein prescribed.

SECTION 3-40-46                HANDICAPPED PARKING SPACES.  The following spaces shall be marked by signs bearing the international symbol of accessibility and are hereby designed as parking spaces for handicapped persons and for use only by motor vehicles displaying a handicapped identification.

                  The parking space at the Northwest corner of Twelfth Street and Eighth Avenue.

The parking space at the Northwest corner of Twelfth Street and Ninth Avenue.

The fourth and fifth parking space, counting from right to left,  to the east of Ninth Avenue on the South side of Twelfth  Street in front of the Belle Plaine Area Museum.

The two parking spaces on the West side of Ninth Avenue immediately North of the No Parking area in front of St. Michael’s Catholic Church.

The first and second parking space on the East side of Ninth Avenue North of Twelfth Street.

For the purpose of this ordinance the terms “handicapped person” and “handicapped parking space” and “handicapped identification device” shall be defined as set out at Chapter 321 of the 2007 Code of Iowa, and said definitions are hereby incorporated by reference. A variance to the space and location requirements for handicapped parking spaces as identified at Chapter 321, 2007 Code of Iowa is hereby granted for the parking spaces identified above.   

SECTION 3-40-47                ESTABLISHMENT OF LOADING ZONE. There is hereby established a loading zone restriction to temporary parking only for the purpose of loading and unloading passengers at the following point on the south side of Thirteenth Street between Eighth Avenue and Ninth Avenue:  East twenty-five feet of Lot One (1), in Block Four (4), Hutton’s Addition to Belle Plaine, Iowa.

Parking in said loading zone is hereby limited to the period of time that passengers are entering a vehicle or exiting a vehicle for the purpose of accessing or exiting the HACAP building. Parking is hereby prohibited and said area is limited for use as a loading zone only on the dates and during the hours posted on a sign at the loading zone site which is hereby declared to be an official traffic control device.

SECTION 3-40-48                ESTABLISHING RESTRICTED ZONE FOR SCHOOL BUSES.   There is hereby established a zone on Ninth Avenue between Fifteenth Street and Sixteenth Street which shall be closed to all motor vehicle traffic except school buses when movable signs are in place showing such restricted use. Such signs shall be in place only on days when school classes are held and during hours commencing not more than thirty minutes before school classes open and extending not more than thirty minutes after school classes are dismissed for the day; this restriction shall not apply to all normal traffic by or for residents living within the restricted zone who shall be allowed access to and from their respective properties.

SECTION 3-40-49                CLOSING ALLEY TO VEHICULAR TRAFFIC.  There is hereby closed to vehicular traffic the alley between Thirteenth and Fourteenth Street and between Fifth and Sixth Avenues. Vehicular traffic shall include all traffic by motor vehicles as defined by Section 3-28-1 of this Code.

ILLEGAL USE OF MOTOR VEHICLES 

SECTION 3-40-50                DISTURBING THE PEACE BY PROHIBITED USE OF HORNS AND BELLS AND SIGNALING DEVICES.  Operators of motor vehicles shall use horns, bells or signaling devices only when passing or as a warning for the safe operation of said motor vehicle and use at any other time for any other purpose shall constitute a disturbance of the peace.

SECTION 3-40-51                IMPROPER MUFFLER.  It shall be unlawful to operate a motor vehicle within the limits of this city with a muffler that is not in good working order or with use of a muffler cut-out, bypass or similar devic

SECTION 3-40-52                EXCESSIVE ACCELERATION, STOPPING AND TURNING.  It shall be unlawful for any person to operate any motor vehicle, including motorcycles, in such a manner that while turning, accelerating or stopping, the tires in such a manner that while turning, accelerating or stopping the tires make audible noise or leave skid marks on the pavement due to the friction of the tires on the pavement. It shall further be unlawful to operate a motorcycle in such a manner that causes the front wheel to leave the ground more than two inches.

SECTION 3-40-53                PENALTIES FOR VIOLATION.

(1)   Each owner or operator of a vehicle parked in violation of this article shall      within thirty (30) days of having attached to their vehicle for the violation, a notice paid at the Belle Plaine City Hall amount of fifteen dollars ($15.00). Failure to do so shall subject such owner or operator to further penalties of this Code. If a vehicle has three (3) days or more outstanding, unpaid parking violations for which payment is late thirty (30) days or more, and the vehicle is found on city right-of-way, this vehicle may be impounded until all fines, towing fees, impound fees and storage fees are paid in full.

(2)   The scheduled fine for a parking violation shall increase by ten dollars ($10.00) if the parking violation is not paid within thirty (30) days of the date upon which the violation occurred.

(3)   The scheduled fine for parking violation shall increase by ten dollars ($10.00) if parking violation is not paid within sixty (60) days of the date upon which the violation occurred.

(4)   Violation of Section 3-28-46 shall be $100.00.

SECTION 3-40-54                FAILURE TO SATISFY PARKING CITATION.  Each owner or operator of a vehicle parked in violation of this chapter who fails to pay within sixty (60) days of being issued a notice to pay shall be issued a uniform citation and cited to appear before the Court.

SECTION 3-40-55                AMENDMENT.  For violations under Chapter 28 of the Belle Plaine Municipal Code which are designated by Section 805.6 of the Code of Iowa to be schedule violations, the scheduled fine for each of those violations shall be specified in Section 805.6 of the Code of Iowa as set out in the Compendium of Scheduled Violations and Schedule Fines. This will be known as Section 3-28-55 of the Belle Plaine Municipal Code.

SECTION 3-40-56                AMENDMENT.  All of the violations of Iowa Code Section 321, as contained in the Compendium of Schedule Violations published by the State of Iowa and as subsequently amended are hereby adopted as violations of the City of Belle Plaine, Iowa, and all of the schedule fines, surcharges, court costs, and bonds are hereby adopted as the penalties for said violations. Therefore, any violation of this ordinance by a violation of a Code section under 321, contained in the Compendium will carry with it the scheduled fine and costs and will be coded as coded in the compendium.

Any violation of the Iowa code sections referred to by this ordinance will also be a violation of this ordinance to be known as Section 3-28-56 of the Belle Plaine Municipal Code.
