Chapter 70 – Airport Commission

SECTION 5-70-1                  CREATION OF ADMINISTRATION AGENCY TO BE KNOWN AS THE BELLE PLAINE AIRPORT COMMISSION.  An administrative agency is hereby created pursuant to Section 330.23 and 392.1 of the 2007 Code of Iowa to supervise under the auspices of the Belle Plaine City Council the operation, planning, and control of all property acquired by the City of Belle Plaine for airport and industrial park purposes.

SECTION 5-70-2                  ORGANIZATION OF AGENCY.  The agency shall consist of five members appointed by the City Council for terms of three years. Four members of the agency shall be residents of the City of Belle Plaine, Iowa, and one member may be a non-resident of the City of Belle Plaine, residing in Benton County, Poweshiek County, Iowa County or Tama County, Iowa. The agency members shall serve without compensation but may receive reimbursement for their actual expenses. The agency members shall from their own group designate a chairman, a vice-chairman and a secretary. The City Clerk shall serve as treasurer of the agency.

SECTION 5-70-3                  DUTIES OF THE AGENCY.  The agency members shall provide all needed rules for the operation, maintenance and improvement, regulation, economic conduct and control of the airport and industrial park facility and shall make and update all plans that may be required for the airport site and industrial park area to serve the purposes for which they were intended. The agency shall at the end of each calendar year quarter present to the City Council an accounting of all receipts and disbursements of agency funds for the previous three months and an itemized listing of cash assets and investments.

SECTION 5-70-4                  AUTHORITY OF AGENCY.  This agency shall have authority to apply for all required licenses and permits in the name of the City of Belle Plaine and, subject to the approval by the City Council, the agency may take action with other public or private agencies, all as provided by Chapter 28E, 2007 Code of Iowa.

SECTION 5-70-5                  RULES AND FEES OR CHARGES.  The agency shall have the power to make rules and regulations for the use of the airport and industrial park area subject to approval of such rules by the City Council. The agency shall have the authority with Council approval to adopt rules for collection of fees and charges for use of the facilities under their control.

SECTION 5-70-6                  PENALTIES.  Violation of board rules which have been approved by the City Council and adopted by ordinance may be cause for denial for use of the facility and such violation may be prosecuted as a misdemeanor.

SECTION 5-70-7                  PLEDGING CREDIT OR TAXING POWER PROHIBITED.  The agency and its membership may not pledge the credit or taxing power of the City of Belle Plaine.

SECTION 5-70-8                  AUTHORITY TO ACCEPT PROPERTY.  The authority of this agency shall include but not be limited to accepting property by gift, devise, bequest, or otherwise.

SECTION 5-70-9                  REPEALER.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION 5-70-10                SEVERABILITY CLAUSE.  If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof that is not adjudged invalid or unconstitutional
